ABOUT US

This website www.eviklyobeads.com (the "Site") is owned and operated by Evik Diagnostic Innovations Inc. ("EvikDx"). If you have a question or complaint about our personal information handling practices, please contact us at info@evikdiagnostics.com.

In this Privacy Policy ("Policy"), the terms "we," "our," and "us" mean EvikDx, and the terms "you" and "your" refer to users of the Site, including visitors and EvikDx customers.

SCOPE

This Policy is incorporated into EvikDx's Terms of Use and applies to the information obtained by us through your use of the Site as described in this Policy.

SITE PLATFORM

Our Site is hosted on the Squarespace platform. Squarespace provides us with the online platform that allows us to sell our Products and Services to you. Your data may be stored through Squarespace's data storage, databases, and applications on secure servers behind a firewall. For more information, you may review Squarespace's Terms of Use and Privacy Policy on their website.

WHAT PERSONAL INFORMATION WE COLLECT AND WHY

When you visit our Site, we collect personal information. Personal information is information that identifies you, or that could be combined with other information to identify you. We collect personal information in the following ways:

Information you provide to us directly:

When you visit or use parts of our Site, we may ask you to provide personal information — for example, your name and email address on our Contact page. We may also receive your contact information when you contact us directly.

If you purchase Products or Services on our Site, our payment processor (Squarespace) collects your email address, purchase history, and payment details (including credit card information) to complete the transaction.

If you do not wish to provide all or some of the personal information required to place an order, you do not have to, but it may mean you cannot use some parts of our Site or order Products or Services.

Information we collect automatically:

We may collect some information about you automatically when you visit our Site, such as information that Squarespace and platforms like Google Analytics may collect about your interaction with our Site — including the geographic location of your IP address, the IP address itself, device type, pages viewed, links clicked, browser type and settings, date and time of use, language preferences, and cookie data. This information helps us improve your experience on the Site.

COOKIES

When you use our Site, it may store cookies on your computer. Cookies are small pieces of information that can help identify your browser and store information for future visits. We use cookies to track usage and to improve ease-of-use and the overall user experience.

Most internet browsers automatically accept cookies. You may configure your browser at any time so that no cookies are saved, or so that you receive a notification when you receive a new cookie. The Site may be used without accepting cookies, although individual functions may be limited.

Our Site is hosted on Squarespace and uses Squarespace business solutions. Cookies are implemented in every site managed by Squarespace. A list of Squarespace cookies is available on the Squarespace website.

HOW WE USE YOUR PERSONAL INFORMATION

We collect and use personal and non-personal information for the following purposes:

•        To communicate with you — including operational communications, order information, changes to the Site, this Privacy Policy, or our Terms of Use; and to provide customer assistance and technical support.

•        To provide and enhance our Site, Products, and Services — by tracking and monitoring your use of the Site and purchases, carrying out technical analysis, and improving your user experience.

•        To protect — detecting and preventing fraudulent or malicious activity and ensuring use of the Site is in accordance with our Terms of Use.

•        To send you general or personalized notices and promotional messages, or to poll your opinions through surveys or questionnaires (with your consent where required).

•        To create aggregated statistical data and non-personal information, which we or our business partners may use to provide and improve our respective services.

•        To comply with any applicable laws and regulations.

SHARING YOUR PERSONAL INFORMATION

We do not share your personal information except under the following limited circumstances:

•        To comply with an order, subpoena, warrant, or other legal requirement issued by a court, tribunal, regulator, or other person with jurisdiction to compel disclosure.

•        To comply with a written request from a police officer or other law enforcement agency with authority to request access to your personal information in the course of an actual or potential investigation into a breach of law.

•        To establish or defend our legal rights. Where possible and appropriate, we will notify you of such disclosure.

•        To an actual or potential buyer of EvikDx (and its agents and advisers) in connection with an actual or proposed purchase, merger, or acquisition of any part of our business.

•        With other companies who assist us in processing your payment for Products or Services.

•        To protect the security of the Site or the security of Site users' information.

AGE OF CONSENT

We do not knowingly collect personal information from children under the age of 18. If we determine we have collected personal information from a child younger than 18, we will take reasonable measures to remove that information from our systems. If you are under 18, please do not submit any personal information through the Site.

DATA STORAGE AND TRANSFER

The personal information you submit to us may be transferred to, processed, and stored wherever Squarespace's servers are located, which may include Canada, the United States, the European Union, and other locations. If your personal information is used or stored outside of Canada, it will also be subject to the laws of the country in which it is used or stored.

DATA SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to ensure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

If you provide us with your credit card information for purchases, that information is encrypted using Secure Socket Layer technology (SSL) and stored with AES-256 encryption. We follow all PCI-DSS requirements. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council.

If we learn of a security system breach, we may attempt to notify you via the email address you have provided or by posting a notice on the Site. Depending on where you live, you may have a legal right to receive such notices in writing.

DATA RETENTION

The length of time we keep your personal information depends on what it is and whether we have an ongoing legal or legitimate business need to retain it.

We will retain your personal information for as long as we have a relationship with you and for a period of time afterwards where we have an ongoing business need to retain it, including for the duration of any applicable limitation periods within which claims may be brought by or against us, or for the duration of any statutory or contractual duties of retention. Following that period, we will ensure it is deleted.

Personal information collected by Squarespace for the purpose of processing a transaction is stored only as long as necessary to complete your purchase transaction, after which it is deleted.

CONSENT

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for any other reason, such as sending marketing information, promotional emails, or contest entries, we will either ask you directly for your express consent or provide you with an opportunity to say no.

THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. Certain third-party service providers — such as Squarespace and other payment transaction processors — have their own privacy policies with respect to the information we are required to provide to them for purchase-related transactions.

Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Use. We recommend that you read the privacy policies of these third-party providers.

You acknowledge that payment processors and other providers may be located in or have facilities that are located in a different jurisdiction than either you or us. If you proceed with a transaction involving a third-party service provider, your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
